What Is an Exchange Deed?
An exchange deed is used when two parties mutually transfer ownership of their respective properties to each other, instead of one party selling to the other for money. It is governed by Section 118 of the Transfer of Property Act, 1882, and — like a sale deed — must be registered with the Sub-Registrar to transfer ownership validly.
Documents Typically Required
- Identity and address proof of both parties
- Original title documents for both properties being exchanged
- Encumbrance Certificate for both properties, where applicable
- Draft exchange deed and registration paperwork
