What Is a General Power of Attorney?
A GPA is a legal document by which a Principal authorizes an Attorney/Agent to act on their behalf in one or more matters — property, banking, business, taxation, or legal proceedings — depending on the powers specified. It is governed by the Powers of Attorney Act, 1882.
A GPA does not transfer ownership of immovable property. Ownership can only be transferred through a registered conveyance such as a sale deed or gift deed.
Documents Required
- Aadhaar, PAN, and Passport/Voter ID/Driving Licence of both Principal and Attorney
- Passport-size photographs
- Property documents, if the GPA relates to property (title deed, mutation records, Encumbrance Certificate)
- Draft GPA specifying the powers, scope, and duration
- Identity proof of two witnesses
When Is Registration Required?
A GPA dealing with immovable property is generally registered for legal validity and acceptance by authorities. A GPA for banking, litigation, or administrative matters may only require notarization, depending on its purpose.
